1. About this Privacy Policy

This Privacy Policy applies to information that Komee may collect about you (“User”, “you”, “your”) in connection with your access and use of the www.komee.gr website (“Website”), our social media pages, as well as through e-mail messages that we send to you that link to this Privacy Policy, and other communications (for example, customer support requests, surveys, and SMS texts) in which you may provide personal information to Komee. The privacy of our Website Users is very important to us, and we are committed to safeguarding it. In line with the EU General Data Protection Regulation (Regulation 2016/679 – “GDPR”), the Greek applicable legislation and the decisions and guidelines of the competent authorities, this Privacy Policy explains what we will do with your personal information.

Those Privacy Policy provisions are part of our Terms of Use of our Website (“ToU”), found here, and should be read in conjunction with them. Capitalized terms that are not defined in this Privacy Policy have the meanings given to them in the ToU.

3.  What information is collected

3.1 Information you voluntarily provide to us

We collect and maintain information that you voluntarily submit to us during your use of our Website. In specific:

  1. In order to make a purchase from our Website you provide us with certain personal information, including full name and e-mail address, delivery address and telephone number, as well as, information regarding the issuance of an invoice, such as VAT number, public tax authority  and company details (in the case of corporate invoicing).

Please note that during the payment process, we do not record or store payment information, such as credit card numbers, etc. You only provide this information directly to the respective payment service provider.

  1. If, for any case we need to send you back any amount of money, you shall provide us with your IBAN.
  2. If you subscribe to our newsletters/marketing communications, you may provide us with your email and/or your mobile phone number so that we are able to send you relevant emails, SMS or multimedia messages (e.g. Viber messages).
  3. You may provide us with any information in the course of email, contact forms, customer support communications through telephone or otherwise or through any other means of communication with us.
  4. When you voluntarily participate in contests, questionnaires and surveys or make reviews you may provide us with your personal information.
  5. We may collect personal information of yours when we receive documents, requests, orders or court applications e.t.c. of you or of third parties,  such as supervisory, prosecutional, judicial, tax authorities, for investigating crimes

We may also collect information on how the Website is accessed and used (“Usage Data”). This Usage Data may include:

3.3 Information we collect from other sources

i. We may collect information from social media platforms and networks, such as Facebook, Instagram, Twitter, and Pinterest. For example, we may obtain of your public profile in a social media platform or network if you express your preference on our webpage (e.g. you “like” our page) or follow us (“follow”) or interact with us through social media. At this point, please, note that if you submit a comment through the corresponding page or make a post, it will be visible to all “friends” and “followers” of our page on that specific social network and we can use the features provided by the same network to respond to you.

ii. Our Website may include Social Media features, such as the Facebook “Like” button, and Widgets, such as the “Share This” button or interactive mini-programs that run on our Website. These features may collect your IP address, which page you are visiting on our Website, and may set a cookie to enable the applicable feature or widget to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Website. We do not knowingly collect personally identifiable information from anyone under the age of 18 (“Minor”) without his/her parent’s or guardian’s consent. ii.    the fulfillment of our pre-contractual or contractual or legal obligations or

iii.   the compliance to our legal obligations or

4.3 Please, note that your personal information includes any information that allows, by itself or in combination with other, your unique identification in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), the applicable Greek legislation and the decisions of the Hellenic Data Protection Authority (HDPA). Any information which is aggregated or anonymized so that it is no longer reasonably associated or trackable to an identifiable natural person, shall no longer be considered as personal information and we may use it for any legitimate and lawful business purpose.

8. Period for which your personal information will be retained

Your personal information will be retained only for the time which is absolutely necessary for the purposes of its collection and processing as described in this Privacy Policy, always respecting the data minimization principle.

Nevertheless, please, note that:

  1. Personal information for customer identification, communication, service contract, service history and payment certification and management are retained for legal, tax, audit and accounting purposes, for the period required by applicable legislation, which is not less than five (5) years from their collection. Where a shorter or longer period of data retention is provided by law or regulation, the above data- retention time shall be reduced or increased accordingly.
  2. If there is a pending issue regarding the contractual or transactional relationship with you, we will retain the necessary personal information until the pending matter is resolved. In case there are ongoing legal actions with Komee that directly or indirectly concern you or in case we deem that the retention of your personal information is necessary to establish, exercise, or defend our legal rights, we may keep your data for a maximum period of 20 years, to cover the possibility of exercising or oppose any legal claim.
  3. Where you have consented to receive marketing communications, we keep your personal information until you request we delete your personal information.
  4. Where cookies are placed on your computer, they are stored for as long as necessary to achieve their purposes (e.g. for the duration of a session for shopping cart cookies or session ID cookies) and otherwise for a period defined in accordance with local regulations and guidance.
  5. Anonymous usage and traffic statistics that do not contain any of your personal information, may be retained for as long as necessary for our legitimate and substantial business purposes, such as the adaptation and improvement of our Websites and services.

When we no longer need to use your personal information, it is securely erased from our systems and records, or anonymised so that you can no longer be identified from it.

9. Your rights

You have the following rights:

  1. To request access to your personal information that we hold.
  2. To request that we rectify the personal information that we hold.
  3. To request that we erase your personal information to the extent that it is no longer necessary for the purpose for which we need to keep processing it, as we have explained above, or when we are no longer legally permitted to process it.

Please, note that we reserve the right to refuse the request to restrict the processing or erasure of your personal data if the processing or retention of such  data is necessary for the foundation, exercise or support of our legitimate interest, legal rights or our compliance our legal obligations.

We will not charge you for the exercise of your rights in relation to your personal data unless, as provided by law, your request for access to information which is unfounded or excessive, so we reserve the right to charge a reasonable fee under the specific circumstances. In any case, we will notify you of any charges before completing your request.

11. Links to third party websites

Any interconnection between this Website and any other third-party website via special links (links, hyperlinks or banners) does not mean that we accept any responsibility for the policies applied by those websites regarding the handling and protection of personal information.

You must make sure you are informed about the protection and management of your personal information by those third-party websites.

12. Changes to the Privacy Policy

We reserve the right to amend the information contained in this Privacy Policy when we consider this appropriate. Should we do so, and if the changes are significant, we may notify you by various procedures through the Website (for example, through a banner, a pop-up or a push notification), or we may even send you a notice to your e-mail address when the change in question is relevant to your privacy, for you to be able to review the changes, assess them and, as the case may be, object or unsubscribe from any functionality.
